These Terms & Conditions (“Terms”) govern bookings made with Nutmeg & Co. Travel Planning & Experiences (“Nutmeg & Co.,” “Company,” “we,” “us,” or “our”). By submitting a deposit, making a payment, or otherwise confirming a reservation, the Traveler acknowledges that they have read, understood, and agreed to these Terms.

DEFINITIONS

​

a) “Company” or “Nutmeg & Co.” means Nutmeg & Co. Travel Planning & Experiences.

b) “Traveler” or “Guest” means any individual who books, purchases, participates in, or is registered for a Nutmeg & Co. travel experience.

c) “Experience” means the travel package, group trip, Carnival experience, itinerary, or combination of travel-related services selected by the Traveler and arranged or coordinated by Nutmeg & Co.

d) “Package” means the specific combination of services included in the Traveler's purchased Experience as identified in the applicable booking page, proposal, invoice, itinerary, or Guest Agreement. Depending on the Experience purchased, a Package may include accommodations, ground transportation, airport transfers, meals or private chef services, selected event access, island experiences or tours, guest support, costume/package pickup coordination, or other specifically identified services. Only services expressly identified as included in the Traveler's Package are included.

e) “Package Price” means the total amount charged for the Traveler's selected Package, excluding optional services, Add-Ons, payment processing fees, or other expenses unless expressly stated otherwise.

f) “Deposit” means the initial payment required to reserve the Traveler's place in an Experience. The Deposit amount or percentage may vary by Experience and will be disclosed before booking. For Travelers participating in a Payment Plan, the first month's scheduled payment is considered the Deposit and is subject to the Deposit terms contained in these Terms.

g) “Payment Plan” means any installment schedule offered by Nutmeg & Co. for payment of the Package Price.

h) “À La Carte Service” or “Add-On” means an optional service purchased separately from the base Package.

i) “Third-Party Supplier” means any independent provider whose products or services are incorporated into or associated with an Experience, including accommodation providers, property owners, transportation providers, chefs, restaurants, tour operators, event promoters, Carnival bands, photographers, beauty professionals, and other vendors.

BOOKINGS & RESERVATIONS

​

a) Submission of an inquiry or booking request does not guarantee a reservation.

b) A Traveler's reservation is confirmed only after Nutmeg & Co. has accepted the booking and received the required Deposit or other required initial payment.

c) Availability is subject to change until the required payment has been received.

d) Packages and pricing are subject to availability.

e) Nutmeg & Co. reserves the right to decline a booking where reasonably necessary, including where capacity has been reached, supplier availability has changed, payment requirements have not been met, or the booking cannot reasonably be accommodated.

PAYMENTS, PAYMENT PLANS & PROCESSING FEES

​

a) The Traveler must pay the required Deposit by the deadline communicated by Nutmeg & Co. to secure the reservation.

b) All Deposits are non-refundable, except where otherwise expressly stated in writing by Nutmeg & Co. or required by applicable law.

c) Remaining balances must be paid according to the payment schedule provided at booking.

d) Travelers participating in a Payment Plan are responsible for making all installments by the stated due dates.

e) Failure to make a scheduled payment may result in the reservation becoming delinquent.

f) Nutmeg & Co. may provide a reasonable grace period or opportunity to cure a missed payment at its discretion. Repeated or unresolved missed payments may result in cancellation of the reservation.

g) If Nutmeg & Co. cancels a reservation because of nonpayment, amounts already paid remain subject to the Progressive Cancellation Policy contained in Section 5 and applicable supplier restrictions.

h) Reservations made after an Experience's payment-plan cutoff date may require payment in full.

i) A Traveler is not considered paid in full until Nutmeg & Co. has received all required Package payments and applicable fees.

j) Optional Add-Ons may have separate payment deadlines and cancellation terms.

Payment Processing Fees

k) Payments made through nutmegandcotravel.com or Nutmeg & Co.'s designated online payment platform may be subject to a payment processing fee or surcharge, which will be disclosed to the Traveler before the payment is completed.

l) The applicable processing fee may vary depending on the payment method, payment platform, card type, transaction amount, or other applicable factors.

m) Payment processing fees are separate from the Package Price and do not reduce the Traveler's outstanding Package balance unless expressly stated otherwise.

n) Where permitted by applicable law and applicable payment processor or card network rules, payment processing fees are non-refundable, including when a Traveler cancels a reservation and is otherwise eligible to receive a refund of all or part of their Package payments.

o) Nutmeg & Co. will not impose a payment processing fee or surcharge where prohibited by applicable law or applicable payment network requirements.

​

PRICING & SUPPLIER CHANGES

​

Nutmeg & Co. makes reasonable efforts to provide accurate pricing at the time of booking. However, international travel and Carnival-related services may be affected by circumstances outside Nutmeg & Co.'s control. After booking, prices may change where necessary because of:

  • Taxes or government-imposed fees

  • Supplier-imposed increases

  • Transportation or fuel surcharges

  • Currency fluctuations where applicable

  • Changes requested by the Traveler

  • Changes in occupancy

  • Significant itinerary or supplier changes

  • Other costs outside Nutmeg & Co.'s reasonable control

Nutmeg & Co. will communicate any material additional charge before collecting the additional amount whenever reasonably practicable. Nutmeg & Co. will not arbitrarily increase a confirmed Package Price solely to increase its profit after booking.

Shared Accommodation & Group-Based Pricing

Where a Package includes shared accommodations, the Package Price may be calculated based on the number of Guests expected to participate in the shared accommodation arrangement.

If the number of Guests participating in the shared accommodation decreases or increases after pricing has been established, the overall Package Price and/or individual payment-plan amounts may be adjusted to reflect the revised number of participants and the resulting cost per person.

Travelers acknowledge that shared accommodation pricing may depend upon maintaining a specific number of occupants. A reduction in the number of participants may result in a higher cost per remaining participant, while an increase in participants may result in an adjustment to the applicable Package Price or payment schedule.

Nutmeg & Co. will communicate any material pricing adjustment resulting from a change in the number of participants as soon as reasonably practicable.

​

For shared accommodations, each guest is responsible for damage caused by the guest or their invited visitors. If a Third-Party Supplier assesses a group or property-wide damage charge and the responsible guest cannot be identified, the charge may be allocated among the occupants or otherwise handled according to the supplier's policies.

​

Minimum Participation & Trip Cancellation

Certain Experiences may require a minimum number of participants in order to secure accommodations, transportation, events, vendors, or other Package components at the advertised rate.

If the required number of participants do not submit their required Deposit or do not continue making payments according to the established Payment Plan, Nutmeg & Co. may determine that the Experience cannot reasonably proceed at the advertised cost.

Before cancelling an Experience for this reason, Nutmeg & Co. may provide the remaining participating Travelers with an opportunity to make up the resulting cost difference, where reasonably practicable.

If the remaining Travelers do not agree to cover the additional cost necessary to maintain the Experience, Nutmeg & Co. reserves the right to cancel the Experience.

In the event Nutmeg & Co. cancels an Experience because the minimum participation requirement or required financial commitment is not met, refunds will be handled in accordance with the applicable supplier refund policies, amounts recoverable by Nutmeg & Co., and any Experience-specific cancellation terms disclosed before booking.

 

PROGRESSIVE CANCELLATION & REFUND POLICY

​

Nutmeg & Co. plans and financially commits to accommodations, transportation, events, vendors, meals, activities, and other Experience components well in advance. For this reason, the amount eligible for refund decreases as the Experience approaches. All cancellation requests must be submitted in writing to nutmegandcotravel@gmail.com. A cancellation is considered effective on the date Nutmeg & Co. receives the written cancellation request.

Cancellation Schedule

 

Unless a different cancellation schedule is expressly provided for a particular Experience:

 

More than 270 days before the Experience begins: The Deposit is non-refundable. Payments made above the Deposit are eligible for refund, less any non-refundable Third-Party Supplier costs already incurred or committed on the Traveler's behalf.

 

181–270 days before the Experience begins: The Deposit plus 25% of all additional Package payments made are non-refundable. Any remaining eligible balance may be refunded, less non-refundable Third-Party Supplier costs.

 

121–180 days before the Experience begins: 50% of the total Package Price is non-refundable. If the Traveler has paid more than 50% of the Package Price, the portion above 50% may be eligible for refund, less any additional non-refundable Third-Party Supplier costs.

 

61–120 days before the Experience begins: 75% of the total Package Price is non-refundable. Any amount paid above 75% may be eligible for refund, subject to non-refundable Third-Party Supplier costs.

 

60 days or fewer before the Experience begins: 100% of the Package Price is non-refundable. No refund or credit will be issued.

 

Additional Cancellation Terms

​

a) The required Deposit is non-refundable once the reservation has been confirmed, except where otherwise required by law.

b) Where Nutmeg & Co. has paid or become contractually obligated to pay a Third-Party Supplier on the Traveler's behalf, those amounts may be non-refundable regardless of the cancellation period above.

c) Event tickets, Carnival registrations, costumes, special-order items, individually purchased services, and certain Add-Ons may become 100% non-refundable immediately upon purchase or confirmation if the applicable supplier does not permit refunds.

d) Any Experience-specific cancellation terms disclosed before booking will supersede this general schedule for that Experience.

e) Refunds, where applicable, will be calculated based on amounts actually received by Nutmeg & Co., excluding non-refundable payment processing fees and applicable service fees, where permitted by law.

f) Any refund issued to a Traveler may be reduced by service fees, website/platform fees, payment-plan fees, payment processing fees, or other transaction-related costs that were charged to or incurred by Nutmeg & Co. in connection with the Traveler's booking or payment, to the extent such fees are non-refundable and permitted by applicable law.

g) Choosing not to participate in an included event, meal, transportation service, activity, or other Package component does not entitle the Traveler to a partial refund.

h) Failure to attend the Experience or an included component without cancellation will be considered a no-show, and no refund or credit will be provided for unused services.

i) Nutmeg & Co. strongly recommends purchasing travel insurance that includes appropriate trip cancellation and interruption coverage.

​

Property Damage: Guests are financially responsible for any damage, loss, excessive cleaning, or other charges assessed by a Third-Party Supplier as a result of the guest or their associated visitors. Any amount Nutmeg & Co. Travel is required to pay on the guest's behalf may be charged to the guest separately from the Package Price and Payment Plan.

TRAVEL INSURANCE

​

Nutmeg & Co. strongly recommends that all Travelers purchase comprehensive travel insurance. Travelers should consider coverage for trip cancellation, trip interruption, medical emergencies, emergency evacuation, baggage loss or delay, travel delays, missed connections, severe weather, supplier disruptions, and other unexpected circumstances. Travel insurance is not included unless expressly stated. The Traveler is responsible for reviewing and understanding the terms, exclusions, eligibility requirements, and coverage limitations of any insurance policy purchased. A Traveler's decision not to purchase travel insurance does not make Nutmeg & Co. responsible for losses that may otherwise have been insurable.

CHANGES TO THE EXPERIENCE

​

a) Travelers may request changes or additions to their booking in writing at nutmegandcotravel@gmail.com.

b) Requested changes are subject to availability, supplier restrictions, applicable deadlines, and additional costs.

c) Nutmeg & Co. does not guarantee that requested changes can be accommodated.

d) Optional events, activities, transportation, or other Add-Ons may be added when availability permits.

e) Once Nutmeg & Co. has purchased or committed funds toward an event ticket, accommodation, transportation service, tour, meal service, or other Third-Party Supplier on behalf of a Traveler, the item may be non-refundable and non-transferable.

​

ACCOMMODATIONS & OCCUPANCY

​

a) Accommodation type, location, occupancy arrangement, and included amenities will be described in the applicable Package or booking materials.

b) Travelers are responsible for selecting the appropriate occupancy type when booking.

c) Pricing may be based on a specific occupancy level. If a roommate or other member of an accommodation arrangement cancels, the remaining Traveler(s) may become responsible for an increased occupancy rate where necessary to cover the revised accommodation cost.

d) Where a shared house or shared accommodation is priced based on a stated number of participating Guests, the Package Price may be recalculated if the number of Guests changes.

e) Nutmeg & Co. will make reasonable efforts to offer alternatives where practical but does not guarantee replacement roommates.

f) Travelers are responsible for complying with accommodation rules, including occupancy limits, property rules, quiet hours, security requirements, and damage policies.

g) Travelers may be financially responsible for damage they cause to accommodations or other property.

 

THIRD-PARTY EVENTS & CARNIVAL ACTIVITIES

Nutmeg & Co. may facilitate or coordinate access to independently operated Carnival events, fetes, Mas bands, tours, activities, and other experiences. Nutmeg & Co. does not own, operate, or control these independent organizations unless expressly stated otherwise. Event organizers may change dates, times, venues, performers, routes, themes, admission procedures, package contents, or other event details. Such changes do not automatically constitute cancellation of the Nutmeg & Co. Experience or create an automatic right to a full Package refund. Where an event is cancelled by its organizer, Nutmeg & Co. will make reasonable efforts to obtain any refund or credit made available by the organizer and pass along the applicable benefit to affected Travelers, subject to non-refundable costs and fees.

CARNIVAL COSTUMES & MAS BANDS

​

Where Nutmeg & Co. assists with Carnival costume registration, pickup, delivery, or coordination, the costume is ultimately supplied by the applicable Mas band or costume provider. Nutmeg & Co. cannot guarantee costume sizing or fit, exact colors or materials, construction or workmanship, availability of a particular section, changes made by the Mas band, distribution times, completeness of accessories, or the Mas band's refund or exchange policies. Nutmeg & Co. will make reasonable efforts to assist Travelers with coordination and communication but is not responsible for the acts or omissions of the Mas band or costume provider.

​

TRANSPORTATION

​

Transportation included in an Experience will be identified in the applicable Package. Travelers are responsible for arriving at designated pickup locations at the communicated time. Nutmeg & Co. and its transportation providers cannot guarantee transportation schedules where delays result from Carnival traffic, road closures, government restrictions, weather, accidents, event delays, security restrictions, or circumstances outside the provider's reasonable control. Travelers who miss scheduled group transportation may be responsible for arranging and paying for alternative transportation.

​

MEALS, CHEFS & DIETARY REQUIREMENTS

​

Where meals or private chef services are included, Travelers should disclose dietary restrictions and food allergies by the deadline provided by Nutmeg & Co. Nutmeg & Co. will make reasonable efforts to communicate dietary requirements to the applicable provider but cannot guarantee an allergen-free environment or that every dietary request can be accommodated. Travelers with severe or life-threatening allergies are responsible for taking appropriate precautions.

​

ITINERARY CHANGES

​

Carnival travel is dynamic, and schedules may change. Nutmeg & Co. reserves the right to make reasonable modifications to an itinerary when necessary because of event schedule changes, transportation issues, weather, safety considerations, supplier availability, government actions, or other circumstances outside the Company's reasonable control. Where reasonably possible, Nutmeg & Co. will attempt to provide a comparable alternative for a materially affected included service. An itinerary adjustment does not automatically entitle the Traveler to cancellation or a full refund.

​

TRANSFERS & RESALE

​

Travelers may not independently sell or transfer their Nutmeg & Co. reservation without prior written approval. Transfer requests are subject to Nutmeg & Co. approval, Third-Party Supplier policies, applicable deadlines, availability, name-change requirements, and additional costs or administrative fees. Nutmeg & Co. does not guarantee that a booking can be transferred.

​

PASSPORTS, VISAS & ENTRY REQUIREMENTS

​

Each Traveler is solely responsible for obtaining and maintaining a valid passport, required visas, immigration documentation, required health documentation, vaccinations or testing where legally required, and any other documents necessary for travel. Travelers are responsible for confirming destination requirements applicable to their individual citizenship, residency, passport, and circumstances. Nutmeg & Co. is not responsible for losses resulting from a Traveler being denied boarding or entry, having insufficient documentation, or failing to satisfy government requirements.

​

FLIGHTS

​

Unless expressly stated in the applicable Package, airfare is not included. Travelers are responsible for purchasing their own flights and ensuring their arrival and departure times comply with communicated transportation windows and the Experience schedule. Nutmeg & Co. is not responsible for airline cancellations, delays, missed connections, baggage issues, schedule changes, or other airline-related disruptions. Travelers should promptly notify Nutmeg & Co. of significant flight changes affecting scheduled arrangements.

​

TRAVELER CONDUCT

​

Travelers are expected to behave respectfully toward other guests, Nutmeg & Co. representatives, local residents, accommodation staff, drivers, vendors, event personnel, and others encountered during the Experience. Nutmeg & Co. reserves the right to remove a Traveler from an Experience or discontinue services where behavior threatens safety, constitutes harassment or violence, causes significant disruption, intentionally damages property, violates applicable law, or materially interferes with the Experience. Where a Traveler is removed for serious misconduct, refunds are not guaranteed, and the Traveler may be responsible for additional transportation, accommodation, or other resulting expenses.

​

Guests must treat accommodations, transportation, event spaces, mas camp property, equipment, furnishings, and other Third-Party Supplier property with reasonable care. Intentional, negligent, reckless, or unauthorized damage may result in immediate removal from an experience, cancellation of services, forfeiture of amounts paid, and/or responsibility for all resulting costs, to the extent permitted by law.

​

PERSONAL RESPONSIBILITY & ASSUMPTION OF RISK

​

Travel, Carnival participation, nightlife, tours, water activities, road events, J'ouvert, Mas, and other activities may involve inherent risks. By participating, Travelers acknowledge risks including crowds, weather, uneven surfaces, physical activity, traffic, alcohol consumption by others, water activities, crime, illness, injury, and other circumstances that cannot be completely controlled by Nutmeg & Co. Travelers are responsible for determining whether they are physically and personally able to participate. Participation in optional activities is voluntary.

​

PROPERTY DAMAGE & GUEST RESPONSIBILITY

​

Guests are responsible for any loss, damage, breakage, excessive cleaning, or other property-related charges caused by the guest or by any person accompanying or visiting the guest during the trip, whether the property belongs to Nutmeg & Co. Travel or a Third-Party Supplier.

This includes, but is not limited to, damage to accommodations, furniture, fixtures, appliances, vehicles, transportation equipment, costumes or mas camp property, kitchen equipment, dining equipment, event or venue property, and other items provided by Third-Party Suppliers.

If a Third-Party Supplier assesses a charge, fine, repair cost, replacement cost, cleaning fee, security deposit deduction, or other expense resulting from a guest's actions or the actions of persons associated with the guest, the guest is responsible for the applicable amount.

Nutmeg & Co. Travel may charge the guest for amounts that Nutmeg & Co. Travel is required to pay to, or that are withheld by, the applicable Third-Party Supplier as a result of the guest's actions. The guest authorizes Nutmeg & Co. Travel to use any payment method or payment information available on file, where permitted by law, to recover such amounts.

Guests may also be required to pay the Third-Party Supplier directly if the supplier assesses the charge directly to the guest.

Nutmeg & Co. Travel is not responsible for damage charges caused by a guest and is not responsible for determining whether a Third-Party Supplier's damage assessment is appropriate. Any dispute regarding a supplier's damage assessment may need to be addressed directly with the applicable Third-Party Supplier.

FORCE MAJEURE

Nutmeg & Co. shall not be responsible for failure, delay, cancellation, or modification caused by circumstances beyond its reasonable control, including hurricanes, severe weather, natural disasters, fire, flooding, epidemics, pandemics, government orders, border closures, civil unrest, strikes, transportation disruptions, utility failures, terrorism, acts of God, or cancellation or material modification of Carnival or related events. In such circumstances, Nutmeg & Co. may modify, postpone, reschedule, substitute, or cancel affected portions of an Experience. Any refund or credit will depend upon amounts recoverable from Third-Party Suppliers and costs already incurred or committed by Nutmeg & Co.

THIRD-PARTY SUPPLIERS & LIMITATION OF LIABILITY

​

Nutmeg & Co. curates, coordinates, and arranges travel experiences using independent Third-Party Suppliers. Unless expressly stated otherwise, Third-Party Suppliers are independent businesses and are not employees, agents, subsidiaries, or controlled entities of Nutmeg & Co. To the fullest extent permitted by applicable law, Nutmeg & Co. shall not be responsible for negligent acts, errors, omissions, cancellations, delays, failures, or misconduct of independent Third-Party Suppliers outside Nutmeg & Co.'s reasonable control. Nutmeg & Co. will make reasonable efforts to assist Travelers when supplier-related issues arise. To the fullest extent permitted by applicable law, Nutmeg & Co.'s liability arising directly from its own services shall not exceed the amount actually paid by the affected Traveler to Nutmeg & Co. for the specific Experience giving rise to the claim, except where prohibited by law. Nothing in these Terms is intended to waive or limit rights that cannot legally be waived or limited.

Guests acknowledge that certain services and experiences are provided by independent Third-Party Suppliers. Each supplier may have its own rules, policies, deposits, damage policies, cleaning requirements, and guest conduct requirements.

Guests agree to comply with all applicable Third-Party Supplier rules and are personally responsible for any charges, penalties, damages, losses, or expenses resulting from their violation of those rules or from damage caused by the guest or persons associated with the guest.

Nutmeg & Co. Travel may assist with communication between the guest and Third-Party Supplier but does not assume responsibility for the guest's obligations to the supplier.

PHOTOGRAPHY, VIDEO & PROMOTIONAL USE

​

Nutmeg & Co. may photograph, videotape, or otherwise record portions of group Experiences, events, excursions, accommodations, activities, and other travel-related experiences.

By participating in a Nutmeg & Co. Experience, the Traveler acknowledges that they may be photographed or recorded during the Experience.

To the extent permitted by applicable law, Nutmeg & Co. reserves the right to use photographs, video recordings, and other visual or audiovisual content in which a Traveler appears for Nutmeg & Co.'s business, marketing, advertising, promotional, and social media purposes. Such uses may include, but are not limited to, the Nutmeg & Co. website, Instagram, Facebook, TikTok, other social media platforms, digital marketing, promotional materials, advertisements, brochures, presentations, and future travel promotions.

The Traveler understands that such content may be publicly visible and may be edited, reproduced, published, distributed, or displayed in connection with Nutmeg & Co.'s promotional activities.

Nutmeg & Co. will not intentionally use a Traveler's image in a manner that falsely implies an endorsement, affiliation, or testimonial that the Traveler did not provide.

Where applicable law requires a separate consent, release, or authorization for a particular use, Nutmeg & Co. will obtain such consent or authorization separately.

Travelers who have concerns about appearing in promotional photographs or recordings should notify Nutmeg & Co. in writing as early as reasonably possible and, where applicable, may be asked to complete an appropriate media preference or release form.

Nothing in these Terms grants Nutmeg & Co. ownership of photographs or videos independently created by a Traveler.

 

PERSONAL BELONGINGS

​

Travelers are responsible for safeguarding luggage, passports, money, electronics, costumes, jewelry, and other personal belongings. Nutmeg & Co. is not responsible for lost, stolen, forgotten, or damaged personal property except to the extent directly caused by Nutmeg & Co.'s own conduct and where liability cannot legally be excluded.

​

COMMUNICATION

​

Travelers are responsible for providing accurate contact information and monitoring communications from Nutmeg & Co. Important information regarding payment deadlines, itinerary updates, transportation schedules, accommodation details, and Experience logistics may be communicated electronically. Failure to review communications does not excuse missed payment deadlines, departure times, or other requirements previously communicated.

SPECIAL REQUESTS

​

Nutmeg & Co. will make reasonable efforts to accommodate special requests but cannot guarantee requests relating to room placement, dietary preferences, transportation preferences, accessibility, event availability, or other supplier-controlled matters unless expressly confirmed in writing. Travelers requiring accessibility accommodations should notify Nutmeg & Co. before booking or as early as reasonably possible.

 

REFUNDS FROM THIRD-PARTY SUPPLIERS

​

Where Nutmeg & Co. receives a refund from a Third-Party Supplier for a cancelled service attributable to a particular Traveler, Nutmeg & Co. will process any amount properly due to that Traveler after accounting for applicable non-refundable costs, contractual obligations, service fees, website/platform fees, payment-plan fees, payment processing fees, or other applicable charges.

Refunds will be limited to amounts actually recoverable and refundable to the Traveler after deduction of applicable non-refundable fees and costs incurred by Nutmeg & Co. in connection with the booking, to the extent permitted by applicable law.

Nutmeg & Co. is not required to advance a supplier refund from its own funds before the applicable refund has been received from the supplier. Processing times may therefore depend upon the Third-Party Supplier.

​

CHARGEBACKS & PAYMENT DISPUTES

​

Travelers agree to contact Nutmeg & Co. promptly regarding billing questions or service disputes so Nutmeg & Co. has a reasonable opportunity to investigate and address the matter. Initiating a payment dispute or chargeback does not automatically invalidate these Terms, applicable cancellation provisions, or payment obligations. Nutmeg & Co. reserves the right to provide booking records, agreements, communications, invoices, supplier commitments, cancellation terms, and other relevant documentation to payment processors or financial institutions in connection with a dispute. Nothing in this provision prevents a Traveler from exercising lawful rights available through their card issuer, financial institution, or applicable consumer-protection law.

 

INDIVIDUAL RESPONSIBILITY WITHIN GROUP BOOKINGS

Each Traveler is individually responsible for complying with these Terms and satisfying their own payment obligations unless Nutmeg & Co. expressly agrees otherwise in writing.

One Traveler's cancellation or failure to pay does not automatically cancel another Traveler's reservation. Where pricing depends upon shared accommodations, transportation, minimum group participation, or another group-based arrangement, one Traveler's cancellation may affect pricing or arrangements applicable to remaining Travelers.

If a Traveler's cancellation or failure to continue payments causes the number of participating Guests to fall below the number upon which the original Package Price was based, Nutmeg & Co. may recalculate the Package Price and remaining payment obligations for the affected Travelers.

Nutmeg & Co. will communicate any material adjustment as soon as reasonably practicable.

SERVICES NOT INCLUDED

​

Unless expressly stated otherwise in the applicable Package, the following are not included:

  • Airfare

  • Passport or visa expenses

  • Travel insurance

  • Baggage or airline fees

  • Personal shopping and expenses

  • Alcoholic beverages unless expressly included

  • Optional events and activities

  • Transportation outside the included itinerary

  • Carnival costumes unless expressly included

  • Beauty, hair, makeup, or styling services unless expressly included

  • Gratuities unless expressly stated

  • Medical expenses

  • Any service not specifically identified as included in the Package

 

GOVERNING LAW

These Terms shall be governed by and interpreted in accordance with the laws of the State of Florida, without regard to conflict-of-law principles, except where another jurisdiction's law must apply as a matter of law. Any dispute arising from these Terms shall be subject to applicable jurisdiction and venue provisions contained in the Traveler's Guest Agreement, if any.

SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in effect to the fullest extent permitted by law.

ENTIRE AGREEMENT & EXPERIENCE-SPECIFIC TERMS

These Terms constitute Nutmeg & Co.'s general Terms & Conditions. Individual Experiences may also be governed by a booking confirmation, proposal, invoice, payment schedule, itinerary, Guest Agreement, or Experience-specific cancellation policy. Where Experience-specific written terms differ from these general Terms, the Experience-specific terms will control with respect to that particular booking.

 

ACKNOWLEDGMENT

By submitting a Deposit, making a Package payment, or otherwise confirming a reservation with Nutmeg & Co., the Traveler acknowledges that they:

  • Have reviewed these Terms & Conditions

  • Understand the progressive cancellation policy

  • Understand that the first month's payment under a Payment Plan is considered the Deposit

  • Understand that the Deposit and certain supplier payments are non-refundable

  • Understand that refunds may be reduced by applicable non-refundable service, website/platform, payment-plan, and payment processing fees

  • Understand that online payments may be subject to disclosed payment processing fees

  • Understand that shared accommodation and group-based pricing may change if the number of participating Guests changes

  • Understand that an Experience may be cancelled if required participation or payment commitments are not maintained and remaining Travelers do not cover the resulting cost difference

  • Understand that Nutmeg & Co. may photograph or record Experiences and may use applicable images or recordings for promotional and marketing purposes as described in these Terms

  • Understand that Nutmeg & Co. utilizes independent Third-Party Suppliers

  • Understand the importance of travel insurance

  • Accept responsibility for applicable passport, visa, immigration, health, and entry requirements

  • Agree to comply with policies applicable to their selected Experience
